Terms and Conditions

These Terms and Conditions (“Terms”) are an agreement between you and Regen Smile Studio (“Regen Smile Studio,” “we,” “us” or “our”), a dental practice located at 3208 N Lincoln Ave, Chicago, IL 60657. They govern your use of regensmilestudio.com and its subdomains, the forms and tools on them, and our text messaging program (together, the “Site” and “Services”).

By using the Site, submitting a form, or opting in to text messages, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site. You must be at least 18 years old, or use the Site under the supervision of a parent or legal guardian, to submit information through it.

The Site describes our practice and the services we offer. Its content is general information and is not dental or medical advice, diagnosis or treatment, and it is not a substitute for a consultation with a licensed dentist who has examined you. Descriptions of procedures, expected results, timelines and before-and-after images are illustrative; individual results vary.

Using the Site, submitting a form or exchanging messages with us does not by itself create a dentist–patient relationship. That relationship begins when we accept you as a patient and you are examined at our practice.

If you have a medical emergency, call 911. Do not use the Site or text messages to report an emergency.

Submitting an appointment request through the Site is a request, not a confirmed booking. A member of our team will contact you to confirm a date and time. Availability, including same-day availability, is subject to our schedule. Appointment times, services, fees and insurance participation are confirmed by our team directly; information on the Site about these is subject to change without notice.

Our cancellation, no-show and financial policies are provided to you as part of becoming a patient and are not stated on the Site.

These are the terms of our text messaging program. They apply in addition to the rest of these Terms and to the text messaging section of our Privacy Policy.

Program description

By opting in, you agree to receive text messages from Regen Smile Studio about your appointments and enquiries. Messages may include appointment requests and confirmations, appointment reminders and scheduling changes, replies to questions you have asked us, pre- and post-visit instructions, requests for feedback, and account or billing notices. We send marketing or promotional texts only to people who have separately agreed to receive them.

How to opt in

You can opt in by ticking the SMS consent checkbox on one of our web forms (the box is never pre-checked), by giving us your mobile number and your permission at our office or on the phone, or by sending us a text message. You confirm that you are the subscriber or customary user of the mobile number you provide and that you are authorized to consent to receive texts at that number. You agree to tell us promptly if you change or give up the number.

Consent to receive text messages is not a condition of any purchase or of receiving dental care.

Message frequency

Message frequency varies depending on your appointments and enquiries.

Cost

Message and data rates may apply. Your mobile carrier’s standard rates for text messages and data apply to messages you receive from us and send to us. Contact your carrier for details of your plan.

How to opt out

Reply STOP to any text message from us to stop receiving messages. We also honor UNSUBSCRIBE, CANCEL, END and QUIT. You will receive a single confirmation text acknowledging your opt-out and no further messages unless you opt in again. You can also opt out by emailing hello@regensmilestudio.com or calling (312) 584-0707. Opting out of texts does not affect other communications you have agreed to receive, such as appointment reminders by phone or email, unless you tell us to stop those too.

Carriers and availability

Text messaging is offered on an “as is” basis and may not be available in all areas, at all times, or on all carriers or devices. Mobile carriers are not liable for delayed or undelivered messages. We are not responsible for delays or failures caused by your carrier, your device, or network conditions outside our control.

Privacy

We handle your mobile number and opt-in information as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes, and text messaging originator opt-in data and consent will not be shared with any third parties.

Your responsibilities

Text messages are not encrypted end to end and may be visible to anyone with access to your phone. Please do not send detailed health information, payment card numbers or other sensitive information by text. Do not rely on text messages for anything time-critical or for emergencies.

By providing your phone number or email address you agree that we may contact you about your enquiry, your appointments and your care by phone and email. Where we use automated technology or prerecorded messages for marketing calls, we do so only with the prior express written consent the law requires, and you can withdraw that consent at any time by contacting us.

Phone numbers shown on our advertising pages may be tracking numbers that route to our office and let us know which advertising led to your call. [If calls are recorded for quality or training, we announce this at the start of the call and obtain your consent as Illinois law requires].

Marketing emails include an unsubscribe link. Transactional emails about your appointments and account are sent as part of providing our services.

If you send us a message, leave a review, or otherwise provide content, you are responsible for it. You agree not to provide content that is unlawful, defamatory, infringing, or that contains another person’s private or health information without their permission. Please do not post other patients’ names or details in public reviews.

With your permission, we may share testimonials or reviews you have made public. We will not disclose your protected health information in marketing without your written HIPAA authorization. You can withdraw permission for us to use a testimonial by contacting us, and we will stop future uses.

The Site and its content, including text, photographs, graphics, logos, the “re·gen” and “Regen Smile Studio” names and marks, and the design of the Site, are owned by or licensed to us and protected by copyright, trademark and other laws. You may view and print pages for your personal, non-commercial use. You may not copy, reproduce, modify, distribute, publicly display or create derivative works from the Site or its content without our prior written permission. Third party names and logos on the Site, including insurance carriers, belong to their owners and are shown for identification only.

You agree not to:

• submit false, misleading or fraudulent information, or impersonate another person;
• use the Site to send spam, harvest information, or contact our patients or staff for purposes unrelated to dental care;
• interfere with the Site’s operation or security, probe or test its vulnerabilities, or access data not intended for you;
• use bots, scrapers or other automated means to access the Site except as permitted by our robots.txt or with our written permission;
• use the Site in violation of any applicable law.

We may suspend or block access to the Site, and refuse or cancel appointment requests, for anyone who violates these Terms.

The Site uses and links to third-party services, including Google Maps, review platforms, social media, online scheduling, patient financing and payment providers, and advertising platforms. Those services are governed by their own terms and privacy policies. We do not control them and are not responsible for their content, availability or practices. A link does not imply our endorsement.

We try to keep the Site accurate and current, but we do not guarantee that it is free of errors or omissions. Information about services, hours, fees, financing, insurance participation and promotions may change without notice and is confirmed by our team directly. Any offer described on the Site is subject to the terms stated with it, to availability, and to applicable law, and may be withdrawn at any time.

The Site and Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, and any warranty that the Site will be uninterrupted, timely, secure or error-free.

To the fullest extent permitted by law, Regen Smile Studio and its owners, dentists, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising out of or relating to your use of the Site or Services, even if we have been advised of the possibility of such damages. Our total liability for any claim relating to the Site or Services will not exceed one hundred U.S. dollars (US$100).

Nothing in these Terms limits or excludes liability for dental malpractice, for personal injury caused by negligence, or for any other liability that cannot be limited or excluded by law. These Terms do not limit any rights you have as a patient under applicable law or under the agreements you sign with us as part of your care.

You agree to defend, indemnify and hold harmless Regen Smile Studio and its owners, dentists, employees and agents from any claims, damages, losses and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms, your misuse of the Site, or content you provide that infringes or violates the rights of another person.

These Terms are governed by the laws of the State of Illinois and applicable federal law, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Site will be brought in the state or federal courts located in Cook County, Illinois, and you consent to the personal jurisdiction of those courts. Before filing a claim, you agree to contact us and give us a reasonable opportunity to resolve the matter informally.

This section does not apply to claims relating to dental treatment, which are governed by applicable Illinois law and any agreements you sign as a patient.

We want everyone to be able to use the Site and to reach us. We work to follow recognized accessibility guidelines and are continually improving. • Changes. We may update these Terms from time to time. The effective date at the top shows the latest revision. Material changes to the text messaging terms will also be posted on the Site. Continued use of the Site after a change takes effect means you accept the revised Terms.
• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Site and Services. They do not replace the agreements you sign as a patient.
• Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
• No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
• Assignment. You may not assign these Terms. We may assign them to a successor to our practice.
